What Happens After Making a Claim?
Eligibility Interview: Shortly after you claim asylum, an official will determine if your claim is eligible for referral to the Immigration and Refugee Board (IRB).
Referral to the IRB: If eligible, your case will be forwarded to the IRB, an independent tribunal that makes decisions on immigration and refugee matters.
Hearing: A hearing will be scheduled where you can present your case before a member of the Refugee Protection Division (RPD) of the IRB.
Decision: The RPD will then make a decision on your claim. If the RPD determines that you are a Convention refugee or a person in need of protection, you may apply for permanent residence.
What if My Claim is Denied?
If your refugee claim is denied, you may have the right to appeal the decision. This can be done through the Refugee Appeal Division (RAD) or, in certain cases, the Federal Court of Canada.
